Welcome to GENAVISE MARKETING L.L.C. (“Genavise,” “Company,” “we,” “our,” or “us”). By accessing or using our website, landing pages, forms, advertising systems, SMS programs, CRM platforms, or digital marketing services, you agree to be bound by these Terms & Conditions. If you do not agree to these Terms, please do not use our services.

2. Services
GENAVISE MARKETING L.L.C. provides digital marketing and automation services, which may include but are not limited to:
• Lead generation campaigns
• Paid advertising management
• Funnel and landing page creation
• CRM setup and automation
• Email and SMS marketing systems
• Appointment-setting and lead nurturing systems
• Marketing consulting and strategy services
We reserve the right to modify, suspend, or discontinue any service at our discretion.
3. No Guarantees (One Exception)
Except for the written performance guarantee described in Section 3.1 below, we do not guarantee specific results, including but not limited to:
• Lead volume beyond any guaranteed minimum
• Appointment numbers
• Conversion rates
• Revenue outcomes
• Return on advertising spend
• Closed transactions
Results depend on numerous factors outside our control, including market conditions, competition, advertising budget, and client responsiveness.
3.1 Performance Guarantee
Where offered and agreed in writing, we guarantee a minimum of 30 qualified buyer leads within the first 90 days of your campaign going live. If we do not deliver at least 30 qualified buyer leads in that period, you get all your money back — a full refund of every dollar you have paid us for that period — and you retain the campaigns, funnels, and automations built for you.
A lead counts toward the 30 only if it is:
• In your agreed service area
• Within your agreed price band
• Intending to buy within 12 months
• Buying for themselves and not on behalf of a third party
• Reachable at a valid telephone number
The guarantee applies to buyer lead generation campaigns only, and is conditional on you maintaining the agreed minimum advertising budget for the full 90 days. Advertising budget is billed by the advertising platform directly to you and is never paid to us, so it is not part of any refund. The guarantee covers qualified lead volume only — it does not guarantee appointments, closings, or revenue.
This is the only performance guarantee we offer. It applies only where stated in your signed service agreement, and those written terms govern if they differ from this summary.
4. User Responsibilities
By using our services, you agree to:
• Provide accurate and truthful information
• Comply with all applicable advertising and marketing laws
• Maintain required business licenses and compliance (if applicable)
• Use our services for lawful purposes only
• Respond to inquiries in a timely and professional manner when applicable
Failure to comply may result in suspension or termination of services.
5. Fees & Transactions
• Service fees will be agreed upon in writing prior to engagement
• Advertising budgets are separate from management fees
• Fees are non-refundable except where a refund is due under the performance guarantee in Section 3.1, which refunds everything you have paid us for the guarantee period
• Late or failed payments may result in suspension or termination of services
6. SMS Communications Policy
By submitting your phone number through our website, forms, advertisements, or landing pages, you consent to receive SMS communications from GENAVISE MARKETING L.L.C. and, where applicable, from our clients in response to your inquiry.
Messages may include:
• Appointment confirmations and reminders
• Follow-up communications
• Lead qualification messages
• Service updates
• Marketing or promotional messages (where consent is provided)
Consent to receive SMS communications is not a condition of purchase.
Opt-out: You may opt out at any time by replying STOP. After sending STOP, you will receive a confirmation message and will no longer receive SMS communications unless you re-enroll. For assistance, reply HELP or contact us at mehak@genavise.com.
Message and data rates may apply depending on your mobile carrier and service plan. Message frequency varies.
Mobile carriers are not responsible for delayed or undelivered messages.
7. Age Restriction
Our services and SMS programs are intended for individuals who are at least 18 years old. By using our services, you represent that you are 18 years of age or older.
8. Intellectual Property
All marketing materials, copy, funnels, systems, automation workflows, and related assets created by Genavise remain the intellectual property of GENAVISE MARKETING L.L.C. unless otherwise agreed in writing. Unauthorized reproduction, redistribution, or duplication is prohibited.
9. Third-Party Platforms
We may utilize third-party platforms, including advertising networks, CRM systems, messaging services, and automation software. We are not responsible for:
• Platform outages
• Account suspensions
• Policy changes
• Third-party service disruptions
• Data loss caused by external platforms
Users and clients are responsible for complying with all third-party platform policies.
10. Limitation of Liability
To the fullest extent permitted by law, GENAVISE MARKETING L.L.C. shall not be liable for:
• Lost profits
• Indirect, incidental, or consequential damages
• Business interruption
• Advertising account suspensions
• Platform-related losses
Except for a refund owed under the performance guarantee in Section 3.1, our total liability shall not exceed the amount paid to us within the thirty (30) days preceding the claim.
11. Termination
Either party may terminate services with written notice in accordance with any signed agreement. We reserve the right to immediately terminate services for:
• Non-payment
• Violation of these Terms
• Fraudulent or unlawful activity
12. Privacy
Use of our services is also governed by our Privacy Policy.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland.
14. Changes to Terms
We may update these Terms at any time. Updated versions will be posted with a revised effective date. Continued use of our services constitutes acceptance of any changes.
